Terms and Conditions of the Natalia Kutyła Online Store

§ 1. General provisions
1. These Terms govern use of the Natalia Kutyła online store, the placement of orders, and the conclusion and performance of contracts for physical products, digital content and educational services.
2. The seller and service provider is NK-HEALTH SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, with its registered office at 14 Jaskółcza Street, 44-337 Jastrzębie-Zdrój, Poland, entered in the register of entrepreneurs of the National Court Register under KRS number 0000927625, NIP 6751756925 and REGON 520214069.
3. The seller can be contacted at contact@nkutyla.com or through the store contact form.
4. The store operates at nkutyla.com and uses Shopify technology.
5. These Terms are made available free of charge in a form that enables them to be saved and reproduced.
§ 2. Store offering
1. The store may offer in particular:
- physical products, including food supplements and products intended for consumption;
- digital content, including e-books, PDF materials, recordings, presentations and downloadable materials;
- online training courses, live sessions, tests, certificates and access to educational spaces;
- fixed-term or recurring access to the Education Centre and its associated community delivered through the Circle platform.
2. The detailed scope of each product, the access period, price, payment schedule and technical requirements are stated on the relevant product page or in the order summary.
3. Content published and sold through the store is educational. It does not replace a diagnosis, medical treatment, medical or dietary advice, or any other individual consultation with a qualified professional.
§ 3. Placing orders
1. The customer selects a product or option, reviews its description, price and access terms, and then places an order through the cart and checkout.
2. Before placing the order, the customer receives a summary showing at least the selected products, price, taxes and delivery charges and, for recurring payments, the frequency and rules of future charges.
3. The customer must provide accurate and complete information and accept the required consents and these Terms.
4. The contract is concluded when the customer receives confirmation that the order has been accepted at the email address provided.
5. The seller may contact the customer if fulfilment requires clarification of customer details, the selected option or the access terms.
§ 4. Prices and payments
1. Prices displayed in the store include applicable taxes unless clearly stated otherwise. Any delivery costs are shown before the order is placed.
2. Available payment methods depend on the type of product and the methods enabled in Shopify checkout.
3. A subscription or other recurring payment requires a payment method that supports automatic charges. Recurring payments are charged to the customer’s card at the frequency and in the amount shown before purchase.
4. An option described as monthly payment may renew automatically until cancelled. A six-month option may mean a single payment for six months, a payment recurring every six months, or an instalment plan, as clearly stated on the product page and in the order summary.
5. The customer is responsible for keeping the payment method current. A failed charge may result in suspension of access until the amount due has been paid, subject to the rules of the relevant plan.
6. Cancelling a subscription stops future renewals. It does not affect charges properly collected before cancellation, subject to mandatory consumer rights.
§ 5. Digital products, training courses and Circle access
1. Digital products are delivered to the email address provided with the order, through a download link, customer account or access to the specified platform.
2. Access to a training course or the Education Centre may require the customer to create an account or accept an invitation to Circle. The customer should use the same email address as for the order unless the seller agrees otherwise.
3. Access may be activated automatically or after payment has been received. For recurring payments, access may be suspended when the plan expires, following cancellation effective at the end of the current period, after a refund or chargeback, or after an unsuccessful payment attempt.
4. The access period, number of modules, supplementary materials, meeting dates, test conditions and certificate requirements are set out in the description of the relevant product. A certificate may require completion of specified materials and successful completion of an assessment.
5. The customer receives a non-exclusive, non-transferable licence to use the materials solely for personal use. Sharing an account, copying, reselling, publishing or distributing materials without the seller’s permission is prohibited.
§ 6. Delivery of physical products
1. Physical products are shipped to the delivery address provided with the order. Available delivery methods and charges are shown at checkout.
2. The standard dispatch time is up to 5 business days after payment has been received unless the product page states otherwise.
3. The customer should verify that the delivery details are correct. Subject to applicable law, the seller is not responsible for delays caused by an incorrect or incomplete address provided by the customer.
§ 7. Withdrawal and returns
1. A consumer has the right to withdraw from a contract for a physical product within 14 days after receiving it unless a statutory exception applies.
2. In particular, the right of withdrawal does not apply to a product delivered in sealed packaging that cannot be returned after opening for health protection or hygiene reasons.
3. For digital content or a digital service, the customer may lose the right of withdrawal once performance begins before the end of the 14-day period if the customer expressly consented in advance, acknowledged the loss of the right of withdrawal and received the required confirmation.

§ 8. Complaints
1. Complaints concerning a product, payment, delivery or digital access may be submitted to contact@nkutyla.com.
2. A complaint should include enough information to identify the order, a description of the issue and the requested remedy.
3. Complaints are considered within 14 days of receiving a complete submission unless mandatory law provides a different period.
4. These Terms do not limit any customer rights arising under laws governing the conformity of goods, digital content or digital services with the contract.
§ 9. Accounts and acceptable use
1. The customer is responsible for keeping login credentials for Shopify, Circle and any other service used to fulfil the order confidential.
2. The store and materials must not be used unlawfully, in a way that infringes third-party rights, compromises service security or violates the seller’s copyright.
3. Where there are reasonable grounds to suspect abuse, account sharing or a licence violation, the seller may temporarily restrict access, after contacting the customer in advance where reasonably possible.
§ 10. Personal data
1. The controller of personal data is NK-HEALTH SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ.

§ 11. Final provisions
1. Contracts are governed by Polish law, without prejudice to mandatory consumer protection provisions applicable in the consumer’s country of residence.
2. The seller may amend these Terms for important legal, organisational or technical reasons or because of changes to the services. Amendments do not affect acquired rights or one-off orders placed before the amendment takes effect.
3. For recurring services, the customer will be informed of a material change with appropriate advance notice where required by law or by the nature of the change.
4. Disputes will be resolved by the court having jurisdiction under applicable law. Consumers may use available out-of-court complaint and redress procedures.
